Annual Marriage Extension of Stayขออยู่ต่อแบบสมรส (รายปี) — ตามคำสั่ง สตช. 327/2557 § 2.18

Our service handles thisModerate

A one-year extension of stay, filed inside Thailand on form TM.7, for a non-Thai national married to a Thai citizen, under Order RTP 327/2557 § 2.18. It follows the initial Non-O and is renewed annually with marriage, residence and financial evidence. Unlike the retirement extension, it permits applying for a work permit.

Duration
Grants a 1-year extension, renewable annually within the 30-day pre-expiry window.
Extensions
Renewed each year, filed within the last 30 days before the current permit-of-stay expires. First extensions are sometimes issued “under consideration” with a home visit to verify a genuine marriage.
Financial requirement
One of: 400,000 THB in a Thai bank account in the applicant’s own name; OR monthly income of at least 40,000 THB; OR a combination totalling 400,000 THB/year. Seasoning: the 400,000 THB must be held for at least 2 months before applying (first application). Some offices expect the balance maintained through the year — confirm per office (as of 2026-05-24).
Fees
Extension of stay: 1,900 THB. Re-entry permit: 1,000 THB single / 3,800 THB multiple.
Processing time
Around 21 working days; many offices grant a 30-day “under consideration” stamp pending a home visit before final approval.

Who it’s for

  • Foreigners legally married to a Thai national who hold a valid Non-O (marriage)
  • People who want a renewable one-year stay, often with the right to apply for a work permit
  • Same-sex married couples (covered since the Marriage Equality Act, effective 23 January 2025)

Key documents

  • Completed TM.7 + photo
  • Passport (with current Non-O stamp) + copies
  • Financial evidence: bank book + bank letter (400k method) OR income certification (40k method)
  • Marriage evidence: Kor Ror 2 and Kor Ror 3 if married in Thailand; if married abroad, a Family Status Registration (Kor Ror 22) plus the foreign certificate/translation
  • Thai spouse’s national ID + house registration (Tabien Baan)
  • Photos of the couple/family at home, plus the TM.30 receipt

Staying compliant

  • 90-day reporting (TM.47); no fee; 2,000 THB fine if late
  • TM.30 address notification on re-entry / address change
  • Re-entry permit before any departure, or the extension lapses
  • Possible home visit / interview to confirm the marriage is genuine — keep ongoing relationship evidence
  • The marriage extension permits applying for a work permit (unlike the retirement extension)

Recent changes

  • Marriage Equality Act (effective 23 January 2025) extends marriage-extension rights to same-sex married couples.
  • 2026 advisories report no major change to the 400k/40k thresholds; closer scrutiny of genuine-marriage evidence continues.

Common pitfalls

  • Deposit not seasoned 2 months, or below the required balance / not in sole name
  • Foreign marriage certificate without Kor Ror 22 / translation
  • Weak genuine-marriage evidence (failed home visit / interview inconsistencies)
  • Missing or late TM.30 or 90-day report
  • Filing outside the 30-day window (too early wastes validity; too late risks overstay)
